Terms and Service

Welcome to Tarmorrow Studio. By accessing our website or booking our services, you agree to be bound by the following Terms of Service. Please read them carefully.

1. Services Provided

Tarmorrow Studio offers professional creative services, including but not limited to:

  • Editorial, Food, and Product Photography.

  • Event and Wedding Videography.

  • On-Location and Commercial Shoots.

  • Brand Strategy and Hospitality Consulting.

  • Studio Space Rentals.

2. Bookings and Payments

  • Retainers: A non-refundable retainer (typically 50%) is required to secure any booking date. Your date is not "locked in" until the retainer is paid and the contract is signed.

  • Final Payment: The remaining balance is due on or before the day of the session or event, unless otherwise specified in your individual project contract.

  • Late Fees: Payments delayed beyond 14 days of the invoice due date will incur a late fee of 5% per month.

3. Cancellations and Rescheduling

  • Client Rescheduling: If you need to move a shoot, please provide at least 72 hours' notice. We will do our best to accommodate, though a rescheduling fee may apply.

  • Cancellations: If a project is canceled by the client, the initial retainer is forfeited to cover the loss of booking opportunity and pre-production time.

  • Studio Liability: In the unlikely event that Tarmorrow Studio cannot perform due to fire, casualty, act of God, or illness, all money paid (including the retainer) will be returned to the client, and the studio shall have no further liability.

4. Intellectual Property and Usage

  • Copyright: Tarmorrow Studio retains the copyright to all images and video captured.

  • Usage License: Upon final payment, clients are granted a non-exclusive license to use the media for the purposes outlined in their specific contract (e.g., social media, website, or editorial print).

  • Promotion: Unless explicitly opted out in writing, Tarmorrow Studio reserves the right to use images/video for promotional purposes, including portfolios, social media, and studio marketing.

5. Studio Rentals and Equipment

For clients renting the physical studio space:

  • Damages: The Renter is responsible for any damage to the studio, equipment, or furniture occurring during the rental period.

  • Conduct: Renters must adhere to all building rules regarding noise, trash disposal, and safety protocols.

  • Overtime: Studio time begins and ends at the booked times. Overtime is billed in 30-minute increments at 1.5x the hourly rate.

6. On-Location Shoots

For projects taking place outside of Tarmorrow Studio:

  • Travel Fees: Shoots located more than 15 miles from the studio may be subject to a travel fee. The client is responsible for all parking fees, tolls, and related transit costs.

  • Permits & Access: The client is responsible for securing all necessary permits and permissions to film or photograph at the chosen location. Tarmorrow Studio is not liable for shoots interrupted due to a lack of proper authorization.

  • Weather: For outdoor shoots, the studio and client will agree on a "rain date" or a backup indoor location. If no backup is available, rescheduling due to weather will be handled according to Section 3.

  • Meals: For on-location shoots exceeding 6 hours, the client is expected to provide a meal break and catering for the crew.

7. Strategy and Consulting

Any brand strategy or "Quantum Hospitality" concepts provided are for the client’s internal use. While we provide expert recommendations, the studio is not liable for the financial performance of any business or restaurant concept resulting from these strategies.

8. Limitation of Liability

Tarmorrow Studio’s total liability for any claim, whether in contract or tort, shall be limited to the total amount paid by the client under the agreement.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the State of New York. Any disputes shall be handled in the courts of Kings County (Brooklyn), NY.

10. Changes to Terms

We reserve the right to update these terms at any time. Continued use of our services after updates constitute acceptance of the new terms.
